A new ordinance was just announced that will have an impact on most of the Long Beach island real estate market. Long Beach Twp, the largest of the municipalities on Long Beach Island, announced that all new homes and re-sales will be required to install a curb. Specifically, as of March 8, 2018, all new residential and resale properties will be required to install curbing in accordance with Ordinance 18-12C prior to the issuance of a Certificate of Occupancy. This provision allows for more on street parking in the busy summer months and reduces sediment run off. Like any decision, there are pros and cons to this. Specifically for sellers, the cost to obtain a resale certificate of occupancy has now jumped by several thousand dollars!

Curbing Requirements in Long Beach Twp NJ

The new ordinance applies to both re-sales and new constructions. In the current form the ordinance reads as follows:

  • This ordinance regulates the installation of curbing and curb cuts for all residential lots, clarifies side yard measurement requirements , amends and clarifies driveway requirements, amends the minimum lot dimensions and amends the impervious lot coverage regulation.
  • Residential lots, for single family homes and multi-family homes, with street frontage of 50 feet or less will have a raised curb with a curb cut for parking of 20 feet.
  • Lots with a frontage of more than 50 feet will be allowed a curb cut of 40% of the street frontage not to exceed 40 feet.

Being a CO requirement, the cost for the installation of a curb will most likely fall on the seller of a home in the LBI real estate market. Long Beach Township is not the first town on LBI to make this rule. This has been the norm in Surf City for a long time. In real estate transactions in Surf City the seller is usually responsible so again, it seems reasonable that the seller will pay for the curb in Long Beach Township real estate transactions as well. The cost to install a curb will depend on the size of the lot but usually comes in around $2,000-$3,000. This is a cost that will have to be planned for when selling a home in the LBI real estate market.
