There are many ways for adverse possession to manifest in the LBI real estate market. It is most commonly seen when adjoining properties have not sold in many years (usually decades) and one party or another constructed something over the property line. This can be as simple as a fence or a planter bed but that alone can be enough to constitute adverse possession. The best way to protect oneself is to have a survey performed on the property and make sure that anything in question is addressed. To rectify adverse possession, it may be as simple as writing a letter notifying the offending party of the encroachment. The resolution of adverse possession should be handled by an attorney, title company, etc to ensure you are protected.
